These terms govern access to and use of the website iajus.pt and of the IAJUS.pt legal research service. By using the website or the service, you declare that you have read and accept them. If you do not agree, please do not use them.
1. Who provides the service
iajus.pt is operated by Celeris Juris Tecnologia e Inteligência Jurídica LTDA, a company incorporated under Brazilian law that holds the IAJUS trademark (hereafter “IAJUS” or “we”). Contact: privacidade@iajus.pt.
2. Access to the service
The IAJUS.pt research service is in operation and access is granted by invitation, in private beta. It follows that:
- access is not open to every visitor of the website: we grant it case by case;
- an access request does not guarantee that access will be granted, nor does it create any obligation to contract, for either party;
- the collection's coverage grows body by body (órgão a órgão) and some features may be changed, added or withdrawn as the service evolves;
- the economic conditions that apply to each type of access are presented clearly and in advance, before any contract is entered into, and no amount is charged to you unless you have accepted them.
3. Nature of the tool: it is not legal advice
IAJUS is a legal research and research-support tool. It does not provide law-practice services (advocacia) and is not legal advice, an opinion or a recommendation on a specific case, and using it does not establish any relationship of mandato (agency) or of patrocínio judiciário (representation in court).
The professional decision, the checking of sources and responsibility for the act performed remain, entirely, with whoever uses the tool.
IAJUS uses artificial intelligence models. These systems can make mistakes, omit information or present outdated information. For that reason we link each result to the available source and identify a page as official only when it has been verified: always check the source before using any content in a legal filing, an opinion or a decision.
4. Content and sources
IAJUS organises legal information from publicly accessible sources, including verified official sources and historical mirrors identified by the service: the judgments (acórdãos) published by the Portuguese courts and the legislative texts (diplomas) published in the Diário da República, in the official gazettes of the Azores and Madeira and in EUR-Lex. What the Portuguese service makes searchable today is case law: the legislative texts have been collected but are not yet searchable through the service, and we say so here so that you do not look for them in vain. There is no legal scholarship in the Portuguese collection. Any collection that comes to be part of the service follows the same rule: only content published by an official source or made available in open access by the respective rights holders.
The collection is made up of public content. We do not collect case files, filings, contracts or dossiers that have not been published by the respective official source, and we do not build the collection from what users search. What the service returns is the document the source published, with a link to the origin.
- The authoritative text (o texto que faz fé) belongs to the entity that published the decision and is shown with a link to the origin, when available. The same applies to legislative texts when they come to be served.
- In case of divergence between what IAJUS shows and the official document, the official document prevails.
- Works protected by copyright are made available only where the licence permits. If you are a rights holder and believe that some content should not be accessible, write to us and we will act promptly.
5. Permitted use
You undertake to use the website in good faith and, in particular, not to:
- systematically extract or mass-copy the content (scraping, bots or other unauthorised automated means), or circumvent technical usage limits;
- try to access restricted areas, other people's accounts or infrastructure, or interfere with the security or availability of the service;
- decompile, decrypt or reverse-engineer the service, except to the extent the law mandatorily permits;
- use the service for an unlawful purpose, to mislead third parties about the origin of the information, or in a way that breaches professional secrecy or the rights of third parties;
- enter on the website third parties' personal data without grounds for doing so, or special categories of data in the free-text message.
If you are a lawyer (advogado/a) or a solicitador/a (a regulated legal profession in Portugal), please remember that you remain bound by your professional-ethics duties (deveres deontológicos), in particular professional secrecy, as regards the information you decide to enter in any tool.
6. Search legal theses, not people
IAJUS.pt was designed to search legal theses and legal situations, not people. To answer you, we do not need identifying data of third parties: describe the question of law, the legal concept (instituto), the claim, the cause of action or the situation in general terms.
You therefore undertake not to enter in your queries:
- third parties' personal data that are not necessary for the legal question you raise;
- special categories of data (art. 9.º RGPD): health, religious or political beliefs, trade-union membership, sex life or sexual orientation, racial or ethnic origin, and genetic or biometric data;
- data relating to criminal offences and convictions (art. 10.º RGPD);
- material covered by professional secrecy, judicial secrecy (segredo de justiça) or a duty of confidentiality by which you are bound.
If you nevertheless enter third parties' personal data in a query, doing so is your decision, and it is for you to ensure that you have grounds for doing so, as the controller of that processing. For our part, we do not use that content to profile anyone, we do not add it to the public collection and we do not disclose it to other users. The processing of queries is described in the Privacy Policy (courtesy translation).
If you are a lawyer or a solicitador/a, this duty adds to your professional-ethics duties towards the relevant professional order (Ordem), which remain fully in force.
7. Intellectual property
The IAJUS brand, the website, the graphic design, the software, the organisation of the content and the databases we build belong to IAJUS or its licensors and are protected by applicable law. These terms do not transfer any right over them. You may consult, print and quote content for your own professional use, indicating the source.
8. Availability of the website
We try to keep the website and the service accessible and correct, but we do not guarantee uninterrupted availability or the absence of errors, and we assume no service level that has not been expressly agreed in writing. We may suspend, change or discontinue features, with notice whenever reasonably possible, and carry out scheduled maintenance.
9. Liability
We are liable under the general rules of law for damage we cause through wilful misconduct (dolo) or gross negligence (culpa grave). To the extent permitted by law, we are not liable for professional decisions taken on the basis of content not checked against the official source, or for indirect damage or loss of profit arising from use of the website or the service.
Nothing in these terms excludes or limits the rights that the law mandatorily grants you, in particular as a consumer.
10. Personal data
The processing of your personal data is described in the Privacy Policy (courtesy translation) and the use of cookies in the Cookie Policy (Portuguese), which form an integral part of these terms.
11. Changes to these terms
These terms may be updated as the service evolves. The version in force is always on this page, with the revision date shown at the top. Relevant changes are communicated, with reasonable notice, to those who have access to the service or are registered on the access list.
12. Governing law and dispute resolution
These terms are governed by Portuguese law. If you use the website as a consumer habitually resident in Portugal, you always benefit from the protection of the mandatory provisions of Portuguese law and may bring proceedings before the courts of your domicile.
In a consumer dispute, you may turn to an alternative dispute resolution entity under Lei n.º 144/2015, de 8 de setembro. The updated list of entities is available on the Consumer Portal (Portal do Consumidor), www.consumidor.gov.pt (opens in a new window). You may also use the European Commission's online dispute resolution platform.
